Personal Information Protection Policy

UP GARAGE GROUP Co., Ltd. (hereinafter referred to as the “Company”) and its affiliated companies (hereinafter collectively referred to as the “Group”) are acutely aware of the importance of protection of personal information, with respect to personal information acquired from customers, parties related to business partners, and other parties and personal information acquired from employees of the Group and others, and will comply with applicable laws and regulations and other rules in relation to the protection of personal information kept by the Group.
In addition, the Group hereby declares that it shall establish a personal information protection management system for embodying the policy described below and make company-wide efforts to continuously improve such system while being aware of trends in the latest information technologies, changes in social needs, changes in business environments and other factors at all times. If the Company or its affiliated company has individually established a personal information protection policy or other regulations for the handling of personal information, and if there is a discrepancy between the contents of this Policy and those of such regulations, the provisions of such regulations established individually shall take precedence.

Article 1 Collection and Use of Personal Information

With the Group’s purposes of collection of personal information being as set forth in the “Announcement of the Purposes of Use of Personal Information” section below, the Group will collect personal information within the scope of such purposes. In addition, the Group will use personal information within the scope of the purposes of collection, will not use such information in a manner that may encourage or provoke illegal or unjust acts and will take related measures.

Article 2 Management and Protection of Personal Information

The Group will manage your personal information in a strict manner and will not disclose or provide it to a third party without your approval. In addition, the Group will take appropriate corrective and preventive measures against unauthorized access, loss, destruction, falsification and leakage of personal information.

Article 3 Governing Law, etc.

The Group will comply with laws, regulations, guidelines established by the government and other rules that apply to personal information retained by the Group.

Article 4 Continuous Improvement of the Management System for Protecting Personal Information and its Mechanism

The Group will continuously improve the management system for protecting personal information and its mechanism.

Article 5 Response to Complaints and Requests for Advice

The Group will establish a contact desk concerning protection of personal information and, if a complaint or request for advice arises, respond to it in good faith.

Announcement of the Purposes of Use of Personal Information

In accordance with Article 21, Paragraph (1) of the Act on the Protection of Personal Information (Personal Information Protection Act), the Group announces that it uses personal information within the scope of the following purposes of use.

Purposes of use of personal information

  1. 1. Purposes of use in the case of acquiring a person’s personal information described by such person directly in a document, etc. (including websites, emails, etc.; hereinafter referred to as a “Document, etc.”)
    • Personal information of a person who makes an inquiry about services of the Company is used to respond to the inquiry;
    • Personal information is used for the purpose of providing services or communications related to the Company's business activities.
    • Personal information of shareholders of the Company is used to make a notification, provide various information, etc., manage shareholders and perform work related or incidental thereto (personal information of shareholders of the Company may be provided to the Tokyo Stock Exchange and other third parties);
    • Personal information of employees, etc. of the Company is used for personnel and labor management, business management, health management, security management, etc.; and
    • Information of those who make a job application directly to the Company is used for recruitment work.
  2. 2. Purpose of use in the case of acquiring a person’s personal information from such person via any channel other than directly through a Document, etc.
    • Information of those who make an application through a private job placement website, etc. is used for recruitment work.
  3. 3. Purposes of use of personal information provided by an outsourcing party
    • To perform work (such as accounting) undertaken from an outsourcing party; and
    • To perform work (such as management, monitoring, maintenance, etc. of systems) undertaken from an outsourcing party.

Dissemination of Matters Related to Retained Personal Data

Personal data retained by the Group (for which the Group has authority to perform notification on the purposes of use, disclosure, correction, addition or deletion of the contents, discontinuation of use, erasure and discontinuation of provision to third parties) are as follows.

  • Personal information of those who make an inquiry about a business of the Company is used to respond to the inquiry.
  • Personal information is used for the purpose of providing services or communications related to the Company's business activities.
  • Personal information of those who apply for a job at the Company is used for recruitment work.
  • Personal information of employees, etc. of the Company is used for personnel and labor management, business management, health management, security management, etc.

3.Safety management measures

The Group will take appropriate corrective and preventive measures against unauthorized access, loss, destruction, falsification and leakage of personal information. For inquiries about safety management measures taken by the Company, please contact the contact desk indicated at the bottom of this Policy.

4.Recipient of complaints about retained personal data

Inquiries about retained personal data (including data that are stored for a short period and are erased in six months or less) are received by the contact desk indicated below.

5.Certified personal information protection organization to which the Company belongs

The Company does not belong to any certified personal information protection organization.

Procedures for Disclosure, etc. of Retained Personal Data

With respect to retained personal data, a request for “notification of the purposes of use, disclosure, correction, addition or deletion of the contents, discontinuation of use, erasure and discontinuation of provision to third parties” (“Disclosure, etc.”) may be made. With respect to records on provision of personal information to third parties, a request for disclosure can be made.
The Company will take the following procedures to respond to a request for Disclosure, etc. of personal information.

1.Receipt of requests for Disclosure, etc.

  1. (1) Please contact the following address.
    The Company sends a “specified form” by mail. So, after its arrival, please send it by mail or bring it in person to the following address after giving consent to “Handling of Personal Information” of the Company.

  2. (2) Please send one of the following documents by mail or bring it in person along with the “specified form” set forth in (1) above so that we can confirm the identity of the relevant person (requestor).
    • A copy of a driver’s license, passport or any other public certificate by which the identity of the relevant person can be confirmed (and that describes the name and address of a person who requests Disclosure, etc.)
    • A copy of a resident record (prepared within 30 days before the day when a request for Disclosure, etc. is made)
  3. (3) If an agent takes the procedures, please send by mail or bring in person one of the documents set forth in a) below and documents set forth in b) below along with the “specific form” set forth in (1) above and an identity confirmation document set forth in (2) above.
    1. a) Document by which the identity of the agent can be confirmed
      • A copy of a document certifying the agent’s authority, the agent’s driver’s license, passport or any other public certificate by which the identity of the agent can be confirmed (and that describes the name and address of the agent who requests Disclosure, etc.)
      • A copy of the agent’s resident record (prepared within 30 days before the day when a request for Disclosure, etc. is made)
      • If the agent is an attorney-at-law, a document showing his/her registration number
    2. b) Document certifying the authority of representation (such as a power of attorney)
      • * If a document certifying the identity of the relevant person or the agent’s authority clearly states his/her registered domicile, delete such information, for example by blacking it out.
      • * The Company will dispose of a document certifying the identity of the relevant person or the agent’s authority in accordance with the Company’s policies.

2.Fee for handling “requests for Disclosure, etc.” and method for collecting such fees

Only in the case of a request for notification of the purposes of use or disclosure, we charge the amount indicated below (including expenses incurred by the Company for sending a reply) per request. Please enclose a postal money order worth the following amount when sending documents related to the request by mail.

  • Amount of fee: 1,000 yen (including tax)

3.Notification of review results

  1. (1) The Company will notify in-house review results according the following method without delay.
    • In the case of notification of the purposes of use of personal information or disclosure: sending a document by mail or delivering it in person
    • In the case of correction, addition or deletion of content of personal information, discontinuation of use, erasure or discontinuation of provision to third parties: telephone or email
  2. (2) With respect to the destination to which a document is sent, an appropriate method is selected from among the following.
    • A reply document is sent by mail to the registered address of the relevant person.
    • An email in which a reply is written or that is attached with a reply document is sent to the registered email address of the relevant person.
    • A call is made to the registered telephone number of the relevant person and a reply is made orally.
