1. California Residents

For our customers and employees of our group companies residing in California (hereinafter collectively referred to as "you" or "your"), this section outlines the types of personal information we collect, how we use it, and your options for managing your personal information, as well as your rights under the California Consumer Privacy Act (as amended by the California Privacy Rights Act; hereinafter collectively referred to as the "CPRA").

In this section, "personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

(3) Sale or Sharing of Personal Information of Minors Under 16 Years of Age

We do not have actual knowledge that we sell or share personal information of minors under 16 years of age.

(4) Sensitive Personal Information

We do not use or disclose sensitive personal information, as defined in Section 1798.140(ae) of the CPRA, for purposes other than those specified in Section 7027(m) of the CPRA Regulations.

(5) Your Rights Under the CPRA

If you are a California resident, you have the following rights with respect to your personal information.

Right to Know - You have the right to request that we disclose the personal information we collect, use, disclose, sell, or share. Specifically, you may request that we disclose the following to you:

  • The categories of personal information that we have collected about you;
  • The categories of sources from which we collected the personal information;
  • The business or commercial purpose for collecting, selling, or sharing personal information;
  • The categories of persons to whom we disclose personal information;
  • The specific pieces of personal information we have collected about you;
  • The categories of personal information about you that we have sold or shared; and
  • The categories of personal information about you that we have disclosed for a business purpose.

Right to Delete - You have the right to request that we delete personal information about you that we have collected. However, we may not be required to comply with your deletion request if we need to retain your personal information for certain purposes. If we determine that we will not delete your personal information in response to your request, we will inform you of the reason for our decision.

Right to Correct - You have the right to request that we correct inaccurate personal information we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.

Right to Opt-Out of Sale or Sharing - You have the right to opt-out of the third-party sale or sharing of your personal information for cross-context behavioral advertising purposes. This means that whenever you request us to stop selling and/or sharing your data, we will comply with your request. Right to Limit Use and Disclosure of Sensitive Personal Information - You have the right to limit the use and disclosure of your sensitive personal information to what is necessary for us to provide our services or goods.

Right to Non-Discrimination - You have the right not to receive discriminatory treatment from us for exercising any of your rights under the CPRA as described in this section.

We will generally respond to requests under the CPRA within 45 days. If we require additional time, we will inform you in writing of the reason for the extension and the length of the extension period. However, requests to opt-out or to limit the use of sensitive personal information will be responded to within 15 business days.

In principle, you may exercise your rights free of charge. However, if a request is manifestly unfounded or excessive, in particular because of its repetitive nature, we may charge a reasonable fee or refuse to act on the request, and we will notify you of the reason for our refusal.

When submitting any of the requests described above, please provide us with the following information. Please note that we may request additional information or documentation from you.

  • Information for us to verify that you are the consumer or an authorized representative (a form of government-issued identification or other identity verification documents are required, except for requests to opt-out or to limit the use of sensitive personal information); and

2. Canadian Residents

For our customers residing in Canada (hereinafter referred to as "you" or "your"), this section outlines the types of personal information we collect, the purposes for which we process such information, and your rights under the Personal Information Protection and Electronic Documents Act ("PIPEDA").

(1) Personal Information

For purposes of this section, "personal information" means information about an identifiable individual.

(2) Personal Information We Hold and Purposes of Use

Please refer to Section 1. (2) above.

(3) Your Rights Under PIPEDA

Right of Access - You have the right to request that we inform you whether we hold your personal information, provide an account of the past and current use that has been made of your personal information, and provide an account of the third parties to whom your personal information has been disclosed.

Right to Correct - If the personal information we hold about you is inaccurate or incomplete, you have the right to request that we correct such information.

We will respond to your request within a reasonable period of time. We will charge a processing fee of JPY 1,000 (including tax) per request.

(4) Sharing of Personal Information with Group Companies

UP GARAGE USA Co., Ltd. may share customers’ names, addresses, contact information (such as telephone numbers and email addresses), transaction histories, and vehicle information with UP GARAGE GROUP Co., Ltd., and franchisees that have entered into franchise agreements with UP GARAGE GROUP Co., Ltd., for the purposes of order management and product delivery.
